Department of Justice Enters Lawsuit to Halt California's New Electoral Map
The US Justice Department have officially joined a lawsuit brought forward by California Republicans, seeking to block the state's recently passed congressional redistricting map.
This legal action, filed in a US district court, challenges the redistricting plan supported by the state's Democratic governor, which was developed in response to a Republican-led gerrymander in Texas.
"The state's redistricting scheme represents a blatant attempt to seize control that violates civil rights and undermines the democratic process," declared the US attorney general.
Democrats have expressed confidence that the new maps will withstand court challenges.
"These opponents were defeated in the election and they are likely to face defeat in the judicial system," commented a spokesperson for Governor Newsom.
Legal Basis
The lawsuit asserts that California's map improperly used racial considerations to significantly advantage Latino communities in contravention of the US Constitution.
"It is unconstitutional to use race as a substitute to further partisan goals, but that is precisely what the state legislature did with the redistricting measure," stated a high-ranking representative from the Civil Rights Division.
Political Context
The legal battle represents the major counterpunch by the Democratic party in the ongoing redistricting war that started with Texas and has spread across various parts of the country.
In contrast to elsewhere, where Republican state legislatures have implemented partisan maps, California's plan needed voter approval, which it received with approximately two-thirds of the vote.
National Implications
The Democratic party need to flip just a small number of GOP-controlled House seats to gain majority of the House of Representatives in next year's midterm election.
The political group controlling the majority will shape the final years of the current administration, deciding if a GOP-controlled legislature will continue to deliver its political program or encounter opposition, investigations and potential further challenges.
